Cars ElectricGT Tesla P85 (S.P)

This is the Tesla P85 car I've been working on my own in order to be used in an "upcoming" eRacing competition in case the client had paid for it.

They have not paid and after several "strange" movements and decisions taken by them, I decided not to sell any part of my project which inlcudes the 3D, 2D, audio, physics and scripts of the car and the 3D and 2D sponsors of the Circuit de Catalunya track.

In order to show how was the development going on to the final client, I installed, tested and showed them beta versions of my project in the simulators of the intermediary company, who is in charge of the simulators they will use for the exhibitions and the eRacing competition, from where they have appropriated of my project.

So, if you see this car (slightly modified) in any social networks, exhibition, eRacing competition, downloadble or anywhere else, you know where it comes from and that it's being used without my authorization.

The project was a request from the company that is in charge of the "virDual" :O_o: section of that other company, who has accepted a stolen project while they are using and modifying my project knowing they don't have my authorization.

So just to confirm, you created the mod. Somehow this company got ahold of the mod and modified it without your permission.

So afterthat their project stopped and now you are finishing the mod?
 
They haven't stopped the project, I stopped the project with them and they stole what they could from my project using and modifying it without my authorization.

Mate no, they have not stolen it. It sounds like you have a contract dispute, but no matter what they own the rights for whatever work you did for them. If they haven't paid, you have a contract dispute that needs resolved in court. But you own no rights to the work under work for hire provisions.

I'd advise you to look at the Alex Mauer vs Imogos software dispute, as it seems similar. I'm afraid you have no rights in this case based on the info you have given.
 
Yes, you are right, will be resolved in Court.

There are some unetic practices they use which I can't comment in public, so it's normal that apparentely, some people can inderstand it as you, but trust me, there are proves of several actuations which will see the light in the future but bu now, people, partners, and companies can get this info to see who these people really are.

That's odd. Any contract I've ever had with a client stipulates that I own all IP on the project until I receive final payment in full. I'd never sign anything to the contrary.

Many many people either fail to compile/insist on an appropriate contractual framework and/or have counterparties who fail/refuse to adhere to said framework. I'll quote an HK/UAE based client I once worked with after he refused to pay: 'Sue me.' AKA in my jurisdiction your contract is worth f**kall. :)

Either way...the absence of sound kills this for me but I have immense respect for the quality and depth of this project! Thanks for sharing.

An unfortunate reality for all of us working under contract, sadly. That being said - that's the reason my contracts stipulate that I own all IP until final payment - at least I can legally turn around and use/sell/whatever that work as much as I want and there's not a thing the non-paying entity can do about it. It enables me to use the work I've done to profit in other ways.

It also means that you're no longer bound by certain aspects of the NDA you've signed; while you can't divulge the client company's secrets, the new IP you've created you can show because it's still your IP, not theirs, and it enables you to publicize the material before they can.
